This is a phased victory of China's rubber industry in the double anti case.
On August 14, in the name of Minmetals chamber of Commerce, China Rubber Industry Association and their member enterprises, Chinese lawyers formally submitted written comments on the product range involved to the U.S. Department of Commerce, pointing out that the product range mistakenly included trailer tires, and asked for clarification and exclusion. At the same time, a number of American importers and trailer and RV manufacturers' associations also submitted comments to the U.S. Department of Commerce on the same day. In the review, China specifically pointed out that it agreed with the proposition of an American importer to exclude the trailer tires marked "for trailer use only" from the scope of the products involved.
Under the pressure of many importers in China and the United States, USW lawyer admitted in a meeting with officials of the U.S. Department of commerce that the product range previously applied for was not rigorous enough, and included trailer tires and ATV tires that did not belong to the tire range of cars and light trucks in the product range involved.
It is understood that the tires that are clearly only used for trailers in the manufacturing and sales process can be excluded from the scope of the products involved if the following conditions are met: the size and load capacity marked on the sidewall appear in the st tire chapter of the tra Yearbook; The sidewall is marked with "ST"; The words "for trailer use only" are marked on the tire wall; The speed class is marked on the sidewall and is less than 81 miles per hour.
At the same time, tires that are clearly only used for off-road use in the manufacturing and sales process are excluded from the scope of the products involved if the following conditions are met: the dimensions and load capacity marks marked on the sidewall appear in the chapters and sections of off-road tires, agricultural tires, industrial tires and ATV tires in tra Yearbook; The tire wall is marked with the words "not for highway"; The speed class is marked on the sidewall and is less than 55 miles per hour; The tire shows a recognizable feature for off-road use.
In addition, for the customs tariff number of the product involved, the US applicant deleted 4011.99 and replaced it with 4011.99.45.10, 4011.99.45.50, 4011.99.85.10 and 4011.99.85.50.
It is also reported that the investigation procedure of the US Department of commerce is still in progress. Before the U.S. Department of Commerce explicitly excludes trailer tires and ATV tires, even if there is only one enterprise in China that only exports these tires to the U.S. market, it still needs to fill in the differential tax rate application questionnaire issued by the U.S. Department of Commerce. Those enterprises that export both trailer tires and car and light truck tires still need to continue to respond to the investigation of the U.S. Department of Commerce regardless of whether the product range has changed.
